Eatonton man arrested on assault, moonshine liquor charges

Such a lovely still to end up being confiscated.

Did he ask the trespassers if one of them dropped the joint when the old man supposedly fired a BB gun?
Don't get me wrong, the old man fucked up. Not only did he commit a crime.
He also committed bad judgement giving consent to a search.

On a side note
If he offered, I'd drink some of his personal homedistilled liquor.

That's a lot of barrels for that small alembic - He's been working hard for 70!

Don't let em in without a warrant and have your bugout plan in place before they arrive... You just might get a heads up..

He willingly let them in. Makes me think that perhaps he didn't know he was doing wrong in distilling his own stuff.

No chance he is getting the still back.
The weapons complaint made it a sure thing they would get a search warrant if he didn't volunteer access.
Kids dropped their joint while they were trying to steal the old man's whiskey.

This is probably the biggest problem of home distilling.
If others know then bad things can happen.

I think the rational behaviour would have been to deny access, to hide the still somewhere else (a friend, some remote place in the countryside etc.) before the Police came back with a search warrant. Unless the Police can obtain the search warrant in a few hours and they can stay in the place for the entire wait.

The quantity that I see suggests that this man had a trade.

This news seem to confirm the general idea that the Police will not come to your house with a search warrant looking for your still. any time I read of somebody being arrested for illegal distilling in the US, it turns out there was a bigger problem behind.

When getting a search warrant the police will generally post an officer to we watch. With a weapon complaint they may not require a warrant. In Canada you give up the right to deny search when you register a weapon.

Curiously, in Italy in such a case the man could not have been convicted for illegal distilling.

The search mandate must specify the precise object, objects etc. that are looked for. If let's say the judge is looking for drugs, and they find a still, they cannot denunciate the person for illegal still possession because that is outside the search scope. I think firearms and explosives are exceptions to this rule, and maybe certain drugs, but certainly not stills or moonshine or other illegal material such as paedopornography, pirated content, clandestine gambling house, unlicensed radioham apparati, illegal stuffed animals etc.

A "no fishing expedition" rule applies.

American law affords the same protections. The warrant must specify what is to be searched for and where on the premises the search is confined. However, that doesn't stop them from finding something illicit, and going back to the judge, because now they have Probable Cause.

Interesting.

Over in the uk, the rule is plain sight.
If they had a search warrant, then they could tear my house apart in the search. If they were to look through my window and see something along the lines of a firearm or a still or a big pile of marching powder, then they could get a warrant within hours.

There are other reasons they have power of entry without a warrant. Years ago, a housemate was arrested. He had some pictures on his laptop. Lets just not dwell on what those pictures actually were.
Weeks later, we were all sat watching tv when the front door opened. Four uniforms and two plain clothes were stood in my hallway completely unannounced. The housemate who was arrested walked in with his head low and a black bin bag in hand. Evidently here to get some personal stuff before they took him to the circle of hell he belonged in.

One of my other housemates had literally seconds before lit up a 'herbal cigarette'. And now there were two coppers in the doorway literally laughing at him and his panicked reaction.

They were quite jovial, and explained they really didnt care, they were here for bigger fish, and that since they entered without warrant or warning anything they saw was inadmissable as evidence for any reason.

How true that actually is, and whether their reaction would have been different if they saw the aforementioned gun, still or pile of powder i dont know.

Im damned sure they have their practical priorities straight, and an unofficial attitude of no harm no foul.

Whilst i keep my mouth shut anyway for fear of thirsty acquaintances trying to empty the stores, i am almost completely unconcerned that the law give the slightest damn about me and a few gallons of whisky.
It's much easier to cut a bit off than weld a bit on...

Plain sight rules always apply. If the police are in a place that they’re legally entitled to be and They see something illegal They can act on it and/or obtain a warrant to act further. If you are foolish enough to let them in expect them to do their jobs. If you do something foolish and they investigate that and see your rig, shame on you.

of course, my point being that over here in these green and pleasant lands at least the police have a sense of practicality.
certain things, if they can ignore then they will.

there was a case a couple of years back where a lass with ME or similar actually walked into the local station and told them point blank she would be planting her own medicinal weed plant. signed a declaration to that effect. they basically told her they didnt care, they had real criminals to catch. later, they were forced by those higher up to go and sieze her plants as she had been on the tv about it and everything, but the unofficial advice was that they still didnt care, just dont go telling the whole population of the uk its fine to break the law. she wasnt even arrested.

as i say, practicality and common sense are more important than the letter of the law.

it's interesting y'all have these rights and that they may protect you.

Here in Canada, woe betide the soft bellied citizen that has the ability to pay....they'll take it all and keep looking for more until you have to resort to crime to survive... then...you're safe!
