In the military/government contracting industry I worked in ALL pallets were required to be treated, as are all pallets used for government contracting to the best of my knowledge. This treatment was not visually evident but was noted by a small stencil. Surplus pallets are often sold cheaply or given away to be used for other purposes so there's no telling where they will end up.
I would never use pallet wood for anything other then for their original use or as crude construction or wooodworking material.
