Does anyone know FOR SURE if it is legal to run your still in order to find the requested information from this form, or are you just supposed to give estimates.

I'm talking about my Govt but yours seems worse.

When I sent in the application, I was called by the batfe office for clarification. They wanted to know if I had the still yet and I replied NO. They said that the proper proceedure is (1) build the still but do not operate it. (2) apply for the permit and estimate the output. (3) They will send an agent to varify the information, Location, Type of still etc. - Then the permit is issued and you can begin operations. If the still has evidence of operation, you can be sited on the spot. --Be aware that you are now subject to an audit 24 hours per day anytime day or night, and you have to keep all the required records for them including the products you distill, the quantity, the quantity of output and it's use. If access is not granted, they can cut the locks and enter for the audit.

when you say they could audit you 24/7 does that also mean if you dont get the permit? i just sent in the form above(hopefully its the right one) but have not built my still yet. i was waiting until i got my permit to see if i should or not.

In the U.S. : By submitting the application you have given the BATF resonable cause to believe that you have constructed a still and/or are operating one. Under this guise they can apply for a no knock warrant to enter your property. If you have not applied for a permit they would have to have other information which would convince a judge that you are operating a still. Keep in mind that if you purchase a used still that shows evidence of use that will be evindence of operation by you. You may be able to beat the charges in court, but it will still be a very expensive and time consuming battle.

I built my still, then applied for the permit. I was asked about the amount it would run and told them I had not run it since I didn't have the permit yet. They said it couild be tested by distilling water but an estimate was just fine. Instead of just mailing me the permit they flew a lady down here from Cincinnati (I live in GA). She asked a few questions and took pictures, a few weeks later I got the permit along with copies of a "production log" to turn in at the end of the year. 10,000 gallons is the max for non tax fuel. A few things I learned:
1) The still has to have a serial number inscribed on it
2) The still has to be in a "secure" (locked) building.
3) The ethanol has to be denatued (I use gasoline)
4) Not only is it illegal to have non-taxed alcohol it is also illegal to have a device for making it if you do not have the permit.
I probably would not have went to all the trouble since I am in a rural location, but using wood to fire the cooker could attract the law due to burn bans from April to Oct ! Take care,

Did you by any chance check with the state of GA ? I am right south of A town and was going to get a Fed permit too. Than I check with the state of GA and found out it would be a cold day in he## before they would let me make fuel water . I pretty much nixed the ideal until I retired and move back home were a Fed permit is all you need. Wish you the best, GA is going to get their tax money .

The way I see it, the Feds issued me a permit in the state of GA. If anybody ask any questions it's a federal case ! Thanks anyway,
