Copyright or Patent?

Relax OD. KS does not own your design. Okay, I am laughing out loud.
I visited the HS website. (curious if he still had my testimonial up that I ask be removed) He still has not paid me the $40
Plastered on every page are warnings that his designs are copyrighted. Having gone through the patent process I wondered if his copyrights give him any protection.
I emailed my IP attorney and asked if his copyright gives any protection for him. I could copy his still exactly if I wanted to but could not copy the “Plans for it”
"You are correct that a copyright does not provide the same protection as a patent. Copyright protection does not extend to utilitarian articles per se. There must be some separate artistic expression in the article that warrants copyright protection. In this case, it appears the copyright would extend to the plans for the still. So long as you do not copy the plans, you can build replicas of the stills and not infringe the copyright."
He did not even steal OD’s design correctly. LOL
