REMINDER !!!!!

REMINDER :::: As of June 7th 2024, it became legal in the state of West Virginia to distill your own alcohol. You are limited to 5 gallons per year if there is one person over 21 in a home, if there is two or more people over 21, then you are limited to 10 gallons a year. You cannot, sell, or distribute. It is for personal use only.

Also remember that federal trumps state. Meaning that even if legal at state level the feds can still shit in your pudding
welcome aboard some of us are ornery old coots but if you do a lot of
reading and don't ask stupid questions you'll be alright most are

Which is all that matters. Per my state law, it's only a $200 fine...on your second offense... :wtf:

Which is the one "Federal" we hope to change. Great first start WV. :clap: Won't happen in my state till the Feds move on it. :thumbdown:

I'm hoping Louisiana follows suit. Our new governor is already making waves and pissing a lot of people off with his new policies. We finally got some common sense back in our capital!

Tell that to the states that “legalized” marijuana possession and use. The federales have more important things to do than seek out and destroy someone with a 10 gallon pot. That aside, you are correct. Federal law preempts state and local law.

On July 10, 2024, US District Judge Mark Pittman in Fort Worth, Texas ruled that the federal ban on home distilling of beverage spirits is unconstitutional. The 156-year-old ban made it a federal felony to produce distilled spirits at home without a license, punishable by up to five years in prison and a $10,000 fine. Pittman's ruling, in the case Hobby Distillers Association v. Alcohol and Tobacco Tax and Trade Bureau (2024), sided with the Hobby Distillers Association's lawyers who argued that the ban exceeded Congress's taxing power and violated the Commerce Clause of the Constitution. The judge found that the location of a distillery is separate from the logistics of collecting liquor taxes, and that taxing power is only authoritative from the time a tax liability arises until it is paid.

The court found that: The federal ban on home distilling exceeds the scope of the federal government's limited powers. The Constitution's tax power does not allow the federal government to ban home distilling, largely because the ban does not add money into the federal treasury or protect federal tax revenue.

I'd say it's a step in the right direction. 🤞
