BENTONVILLE, Ark. (AP) - An accused moonshiner says authorities tainted the evidence in his case when they allowed a still seized from his home to be put on display at the Benton County Fair.
Forty-3-year-old Eric Dailey Sr. was arrested in November 2007 for illegal distribution of a distilled beverage. Public Defender Jay Saxton filed a motion yesterday asking for a suppression hearing, at which he will ask a judge to disallow the still as evidence. Saxton says the integrity of the evidence was compromised by the display.
The Benton County Sheriff's Department has kept the copper still in evidence since it was seized in a raid in late 2007. Court documents show that Dailey told investigators he produced a mash liquid comparable to 45-proof wine or beer, by combining sugar, honey, water and yeast.
The still was placed in an exhibit hall at the fair during its run September 8th through the 14th. The still stayed overnight during that week, and there was no security to maintain integrity of the evidence, according to the motion.

My uncle (about 70 years old now) lives in a small south-west Warshington town. I was talking with him this last summer. He had a neighbor that made his own corn whiskey for years, and also used sugar (hhmmmm. … sounds familiar) and that it tasted quite good. He said that the feds busted him (the neighbor) on the charge of giving the hooch to teenagers. My uncle didn't believe he actually did, but that some of the neighborhood kids stole it. Didn’t say if he went to prison, but I got the impression he didn’t. My uncle said that when he died, the neighbors daughter had a large trash dumpster delivered to the house and cleaned it out to sell. He said it broke his heart to see that beautiful all copper still laying upside down in the dumpster.
