Well, I've finally made it back home from Wyoming. We got dad in an assisted living facility in South Dakota about 20 minutes from my brothers ranch and I'm damn glad that's over with.

Driving back east through South Dakota I was stopped by the SDHP. He said the reason he stopped me was because I was weaving from lane to lane, that was lie #1. When he told me I needed to sit in his cruiser to do the paper work I knew something was up and it was confirmed when I saw he had a dog. He said he was going to have the dog "smell" my truck explaining that if the dog "hit" then he would have probable cause to search my vehicle.

Well of course he said the dog "hit" on my truck. There's just a couple of problems there. 1) There were no drugs of any kind in my truck. 2) There have NEVER been any drugs of any kind in my truck (except for prescriptions for choloresterol and BP). So I had to stand in the ditch for an hour while two cops went through my truck with a fine tooth comb.

I am sick of the liberties cops are now taking. If they want to search you then they can just make something up for an excuse. I was not breaking any laws. I was not speeding, not wandering lane to lane. I was stopped purely and simply because they wanted to search my vehicle. This is presumption of guilt NOT presumption of innosense as our constitution gaurantees. What will be next?

I hear you big R. As far as I know...that could have been a ruse used by cops looking for "money". Here's how it works. The whole "dog" thing...is to get them to bark. Now, the deal is...if they find "drugs"...it's actually a LONG night for them. They got to process you, the drugs, etc., etc. They don't want to find 'drugs'. What they want to find is "money". And lots of time people coming from out of state..may have a lot of cash on them for one reason or another (just concluded some business out of town, going to buy something, just sold something, or travelling cash). This is why they stopped you in the first place. The dog is actually to get proof of drugs being in your vehicle and therefore any cash they might find...would be "drug money". Some states have passed laws that this is enough to confiscate your money (if not your vehicle as well).

After gettting positive indication for drugs...they search. They dont' find the drugs...but find large sum of cash (which they will say is probable cause to test the money...ie., that you had the drugs but sold them). Then they have the dog sniff the "cash" and he barks. At that point, they say it's drug money and your vehicle has been used to transport it. You starting to get the drift? Now usually one of two things happen. You can sign a waiver and let the cops keep the cash and go home with your vehicle. OR you all go down to the station and they take your money and put some chemical on it that will show "any" drug residue down. This will test positive for cocaine residue and now you are a coke dealer..on your way back from a sale. Under Rico act...everything goes....your car, money, and any property in the vehicle. And God forbid you have a weapon in your car.

I've never personally experienced this, but I've heard about it. And saw a show on TV exposé about it. (I think it was in Florida).

guess I thought it gave them a reason to ask a judge for a warrant to search....I would have notified the officer that I was going to call my lawyer about they actions they were proposing to go....Police know this, they use their badge to employ scare tactics into getting what they want....My buddy went through the same situation down in the park (Yellowstone is all federal too). Lady came in with dogs and said she was going to search their rooms with dogs. He told her no and made her get a warrant...which the judge denied, judge required more cause than a dog sniffing around... Sorry to hear about your bad dealing with these guys....Another request you can make is to review the tape footage they have of you before they pulled you over...That is pubic domain...

I feel your pain. I traveled for a living for a long time, only gave permission for a vehicle search once (big mistake) and still get searched a few times. They have a badge, gun and a partner who, if one lies the other will back him up. Going after the police as an individual just never struck me as a good set of odds, but it still has to piss you off.

I saw a study a while back. Dont remember the exact numbers, but it was an unbelievable % of 100 dollar bills test positive for cocaine/meth. So testing the money is bullshit. You may have got that bill legitimately, but the guy before you rolled it up to sniff a line.
I live in MN. My inlaws got stopped in SD on the I90. same deal. Brought the dog in and went ape shit on there car. They were passing through from a trip out west. Cops told them after the search (over 1hr on side of highway) that there have been a number of drug runners passing through from califonia to MN with meth/cocaine. Matter of fact, there was just a huge meth bust 50 miles from me last week. Almost 20lbs. came from cali/mexico they think. Biggest meth bust in MN history. So if your passing through with out of state plates, they are going to get ya. Wether you like it or not.

The laws are no longer on the citizens side...........Plus when you look at how large the police department's budgets are no wonder so many people are getting pulled over for fishing trips by the cops........ Most of this activity started when the laws where changed to allow the local law enforcement to keep the money/vehicles/ houses etc.

I watched a show a few weeks ago......In NYC the police where allowed to stop anyone on the street and search them with out cause.........scary stuff.....

There is a link to a video here somewhere that is a law professor talking about why not to talk to the cops.......I have seen it months ago....But everyone you know should watch it.........

They can pull you over for "not wearing your seatbelt". So, all he has to do is pull ya over...."oh, I thought I saw you without your seatbelt on.., as long as I got ya here... Im going to search ya now"

Yes wlikker. That's exactly the point the scam. After they get the dog to bark at your vehicle and search it, any money they find ..the dog is gonna bark (ie,. it's drug money).

Policemen are like distillers. Good ones and bad ones. They do what most other don't want to do. They have to deal with the idiots in society. They don't do it for the money. Sometimes what they do makes a difference.

No......... they don't do it for the money....... it's called an over inflated ego...........Now I will say this ALL cops are not bad........just corrupt!......... they are corrupt by the very rules that they live by. We teach our kids to respect the law..... but the law is allowed to lie to you any any way they wish to get information........ just given that fact............. breeds corruption/harassment.

On a Brighter note, I left some tools at home.. Had to make a run from the shop. A quick one. Sherriff deputy got me doin 71 in a 55. He came over the hill at me and I nailed the brakes. I saw him slowing down. I just pulled over and waited for him. "a little fast there" he said. " but you hit the brakes fast"... Not quick enough, I laughed. Handed him my license. He went back to the squad. I watched him fumbling with ticket books and shit. I figgerd I was in for it. He gets out, comes up to the window and says, "Think your getting a ticket, dont you? I saw you watching me in your mirror." "did you like that little trick, me playing with the ticket books?" "I got ya!" and he laughed, and handed me back my license. "Have a good day, " he says. I just about shit.

A while back when I was teaching my son to drive his new truck. Stick shift. He stopped at a stop light on a hill. A motor cop pulled in behind us. He got so nervous he killed it three times. Finally I looked him in the eye and said f%&$ that cop and drive. And he pulled away good. Of course to cop follows us a bit and hit the lights. My son bout had a cow. I had to tell him pull over now right there. The cop came to my side looked at me with a grin and said. Dad? I said yep. He said first time with a stick? I said no but you made him about shit his pants. He said I know I did. That's why I pulled him over. He then walked around to my sons side and told him hr was sory for making him so nervous. And that he should not worry about every cop on his but. That he was just on his way home. And didn't really care what he was doing. And gain he was sorry. Then he looked at me and said Dad take him somewhere else till he gets better. I said will do. He then slapped my son on the shoulder and said let me get my bike from behind the truck before you try to pull away. And laughed.

I thought that was one of the best things I've seen a cop do in a long time. I've since seen him around a couple times. He always nods and says Dad! :lol:

So,

If that was what happened, what steps can someone take to NOT allow a criminal con artist (wearing a badge) to not have the power to do this?
