I live in Arkansas,
If I got caught..... The most I would have is a gallon or so....
What is the most they could get me with?
Can they prove the gallon I have is "Home Made"

Actually, if hooch is not in a "taxed" bottle, it is pretty easy for the man to know it is homeade hooch. There are execptions to that rule, but if they find you with 4 1qt mason jars full of hooch (or a gallon jug), it is pretty simple to tell. If it is in commercial post taxed bottles, then it is much more difficult for them to tell. If you only have a gallon at a time, and can keep your still hidden away, AND if your hooch is close to what was in the commerical bottle, then there is very little they can do.
Note if you are "trying" to sell this product, then you will be caught sooner or later. The reason the government cares at all about this "hobby" is because they make such a slaughter in taxes on the legit distilleries. The gov is VERY greedy when it comes to taking its share of the weath. When you hold out, they get VERY upset.

If they "catch" you in a run, they can (and probably will) fine you, and certainly will take your still. They pretty much have to, to "protect" the law. Same thing as a copyright or patent holder. If someone steals your work, you have to fight it, or possibly lose your rights. Now the government does not have to protect the laws quite the same, and you do see "selective" prosecution of the laws, but the same idea holds.
I would say, if it does happen, you might try to social engineer your way out, i.e. pour'm a drink and hope they look the other way

Edit: Usually the only way you will get in trouble is if someone else "turns you in". Hence, be nice to your partner, and your neighbors. Be SURE your neighbors do not think that your late night activity in the garage is cookin up meth, or something such as that.

tater, the ad hominem isn't necessary, you've made it quite clear you dislike moonshiner, we get it.
as for penalties, i don't know. i know that Jerry Walstead got busted selling 1,000+ gallons a week in the early 1970's and was popped for a big felony. this was in Washington state. after that he couldn't own a firearm, for one thing.

1 gallon of moonshine is probably worth what, $10 in taxes? not a huge theft from the state IMHO.

Dont know him well enough to make that call.So I guess you dont get it.Problem Ive had with moonshiner and some other newbies is that they dont seem to be doing much research by the questions they ask.Or even bothering to take notice under which topic there posting under.Many of the posters on this fourm have told me they like helping fellow distillers the same as I do but get tired of the ones that want to be spoon fed.I do to.You would think with all the info that been provided on this fourm that fokes would read it some.And Moonshine reason I asked your age wasI figured by way you asked questions you might be a kid if that answers your question if not either reply to this post or im me and ill answer anything you ask.Anybody else gotta anything they wanna get off there chest to tater same goes for all.

It gets particularly nasty when the feds charge you under the anti-racketeering act, (RICCO). Not only you, but your buddy, your family, the grocerer who sold you the sugar, the clerk who sold you the gallon jar, the hardware store owner, etc., in other words just about anyone they care to prosecute, and they have been very inventive at times. And Yes, they can seize your vehicles, home and other assests if they think it was used or intended to be used to break the law, or if it is the fruits of the proceeds derived from breaking the law. And if they do, then the legal burden to prove that it wasn't will be on you, not them. Will they for a single gallon? Probably not, but you are betting your freedom on it. They, (ATT), have a low priority on illegal distilling , but would be more interested if you are note worthy, famous or a public figure. Then there is the question of local law enforcement and what their law enforcement priorities are at any given time. Your guess for your local police would be better than mine. So be aware that this isn't a game, it potentially has some serious consequences.
