Another thing is peoples knowledge of it (at least around here). Around our parts 99.9% of the people I run into think it's legal to do if it's for personal uses only and not for sale. I just tell 'em the feds don't like it, and the state law doesn't address it....I just keep it at that. If they want to know more they can look into it...

I find the same thing. Folks think it's ok and will talk about it, not thinking it any big deal. That gets in front if the right ears and the authorities start poking around and then you have big problems.

According to reports, 40-year-old Daniel McGuire of Mountain City, Tenn., was seen at a restaurant in Lake Wales on Wednesday by a part-time Lake Wales police officer with several containers of what was later determined to be moonshine in his trunk.

Yep. Its all about the taxes. It was written into the constitution by the fownders of or great country just so the could collect rvenue. By the way, its the only tax that is written in the constitution and all others should be illegal.

Not sure when it happened but just read an article on line that a person was busted by the feds in Alabama for having a coffee pot still. If they are going to bust an operation that small then we all need to be extremely careful!

Might not have been all that small... They make coffee urns that are quite large... 30 - 100 cups is not unusual...

One gallon. Said to be capable of making half a gallon a day. :)

Very interesting. Here certain people can summon a swarm of QC's to defend their case at taxpayers' expense and then strut around as if they are villified an innocent. If you'r doin it yourself on a budget then expect to be screwed and punished.

Reminds me of Mugabestan where the local dollar is worth less than toilet paper and slightly more than newspaper.

Pot plants are a little hotter than most crops and shrubs, but grow lights inside garages and sheds also put off significant heat.

If they'd just tax crucial ingredients, I can't see as there'd be a problem. If you spoil a batch and drink it anyway, you suffer the consequences. Just as you would if you undercooked poultry, but it's not illegal to fry chicken on your own stove.

I wasn't sure if anyone had seen these moonshine busts in N.C.

NC agents seize moonshine, bust whiskey still

RALEIGH, N.C. (AP) -- State alcohol control agents raided locations in three counties, seizing hundreds of gallons of what they say is illegally made moonshine.

The state Department of Crime Control and Public Safety said Wednesday that since last week the raids have resulted in seizures of cash, personal property and multiple arrests.

State Alcohol Law Enforcement agents and Johnston County sheriff's deputies seized 255 gallons of the homemade liquor in Benson, and destroyed nearly 4,000 gallons of mash used to make the bootleg whisky.

Agents also found 294 gallons of liquor in Warrenton and six gallons of moonshine in Hollister.

Four people face a variety of charges stemming from the operation.

Moonshine bust in North Carolina: He didn't pay the Tax Collector

A sign of the Times in Obama's America: Avoid Taxes, Go Directly to Jail...

From WRAL, Raleigh/Durham, Oct. 10:

Wilkesboro, N.C. — State Alcohol Law Enforcement agents seized 929 gallons of moonshine Wednesday and arrested a Wilkesboro man, authorities said Friday.

Roger Lee Nance, of 1117 Shew Ridge Mission Road, was charged with possession of non-tax paid liquor, possession of non-tax-paid liquor for the purpose of selling, and possession of equipment and ingredients intended for the use in the manufacture of an alcoholic beverage.

“This is one of the biggest seizures of white liquor I’ve seen come out of the mountains in my career,” ALE Director John Ledford said in statement.

The libertarian blog Indentured Servent Girl comments:

Yeah, I know it wasn't the hooch that was illegal...it's that he didn't pay taxes on his stash. That should tell you something. You aren't allowed to have any fun unless you pay the tax man first.

Too far to drive, even for free likker. I hate to see anyone get busted for this hobby, but it sounds like he violated many of our rules, mainly "don't tell don't sell"

Exactly, also pay close attention to his doubler.

I may be wrong but that looks like a steel drum to me. Plus alot of plastic jugs behind the mason jars, and I'm not even too sure about his still unless it is a double boiler, look like a cast iron pot to me. :x

Yeah I don't think he was a hobby level distiller.

Nothing wrong with having a little reserve for the kinfolk when they visit, but with 929 gallons you would have to have a pretty big family comin over all the time.

That's where the taxes come into play and where people get busted by the IRS.
From my understanding it don't matter if you sell or not, just having homemade liquor, they can still get you for the unpaid tax on the liquor.

I may be wrong but I think that is the case, Uncle Sam gotta get his no matter what, at least here in the states.

Sales can push things to a whole new level... Not only can you be charged for not paying liquor tax but also for not paying sales tax or income tax...

While governments may not like hearing it, private citizens do not have to pay tax on anything they make for personal use... It really is just that simple... If no money changes hands for the end product, no tax is owed... But I digress...

A few years ago a guy in the local area was busted for moonshining and bootlegging. He worked for a local winery and was distilling the dregs from the wine fermentation vats. His still was a beer keg and a fractioning column. He was attempting to pay off a credit card bill that his son had run up. The police visited him about another matter and wanted to take him in for questioning. He asked them to give him a minute to go into his basement and turn his still off. Bad Idea. The judge at his trial stated that he had looked up the data and it had been 30 years since the last case of this nature. I don't remember exactly what his punishment was but I don't think he served time.
