Man, 19, guilty of making booze
http://www.dispatch.com/live/content/lo ... ml?sid=101
A recent check of Rotkiske's Facebook profile showed this comment from him: "ok once I get the distillery up and running to the level i expect, i'll get a good amount of money rolling in SO I wont have to depend on the Auto Body/ painting/air brushing stuff to put food on the table."

If stupidity got us into this mess, then why can't it get us out?

Sure is.
This bit was interesting:

Re: Man, 19, guilty of making booze
Why does this guy have to be stupid for selling booze ? Yes he ain't too bright for advertising it, but the way I interpid these comments you guys say he is stupid for selling. Booze have been sold world wide, legal and illegal for thousands of years to make a living, why all of a sudden is this stupid? Because some of you decided to do it as a hobby ? In my community a large percentage of people know, or at some point in time dabbled with the sale of bootleg, excluding the Yankee's that have moved in. KY,WV,VA and NC have a rich history in the manufacture/sale of whiskey, everyone stupid ? And NO, I am not selling moonshine, or do I have plans to, but I do not judge my neighbors or call them stupid because I do not agree with what they do, or how they do it.
PS: Just finished some Apple Brandy, it turned out really well Also made some Banana brandy, that I was not so impressed with, but my brother loved it. I have found this forum to be very very helpful, and saved me from allot of beginner mistakes

I guess if your goal is to be arrested, spend your money on an attorney, get to meet educated people like the Judge, lose your equipment, and have your home searched, then selling illegal liquor could be your thing.
For me, thanks, I'll pass. The dude that was busted was stupid for the choices that he made. Unless his goal was to be arrested. Most of us in this forum would really prefer to stay out of the court system, so we make choices that keep use out of the legal system.
Be discreet, keep your distilling "hobby" to yourself and your closest friends, and don't sell.
Or not...
Bull.

It' s one thing to say he's stupid. I think we can all agree on that.
Calling him a snot-nosed ignorant bastard is just malicious, what happened to giving a fuck about your fellow man?
He's 19 and he sold some booze. It's not exactly 'too late' for him to sort his shit out - no need to write the poor little fucker off. Insulting the shit out of someone's bad behaviour just ensures that anyone else doing the same ignores everything you say - because they find you offensive - and the problem is perpetuated..

Re: Man, 19, guilty of making booze
Why pass such harsh judgment on the man? I did a lot dumber things than that when I was 19 and I don't think any of my peers would consider me stupid. Selling it versus giving it away is a somewhat artificial moral line that has been drawn here anyway. I have no moral problems with people making it, giving it away, or selling it, and all of it is illegal. It is not like he was scamming people, stealing, abusing his girlfriend, or making meth. Why would the judge's ruling not be severe enough? He is not exactly a violent offender or a danger to society. What would be the purpose of a stronger sentence? To make him really wish that he had not made and sold it instead of just sort of regretting it? The purpose of law is not to ruin people's lives.
Posting stuff on facebook was not his problem at all, it was someone who ratted him out, my guess would be a friend, or a friend of a friend. If he had given it away instead of selling it, this person might have ratted him out anyway. If anything, the moral of the story should be make sure you can trust your friends. Nothing worse than a rat. I hope there is a special torture device in hell for people who ratted out their friends.
Do you guys on here really have a moral problem with someone selling shine? I understand that it increases the risk of getting caught and possibly increases your sentence once you do. I also understand that it could hurt the greater communities' quest of legalization.... but morally, I don't see how it is any different from making wind chimes at home and selling them on the side.

And as for being tough on the young lad, it's the rite of passage that goes with the territory... I don't know about the rest of you but where I come from you get pretty trashed about when you make mistakes... It's what wises you up to what society does and doesn't accept... You don't get a choice in whether you like it or not, it's what society dishes out... Don't pat him on the head with the excuse that boys will be boys... That's what got society to the point we're at now - adults getting soft...

Re: Man, 19, guilty of making booze
Well, there is the tax evasion. If he is making bad / unsafe shine and selling it, it reflects badly on all of us. Wind chimes don't have the potential to do harm. While I'd love for home distillation to be legalised for all my brethren overseas, I strongly believe that to sell things to others, you should be licensed, if not because of the whole tax evasion thing then for the enforced quality standards. Just like when you open a restaurant, you have to conform to food safety guidelines.loneswinger wrote:Do you guys on here really have a moral problem with someone selling shine? So yeah, I don't know if I'd say that's a 'moral' problem, but that's my problem with it. Potential of his actions to harm others.

loneswinger and others who think that this 'fool' has been badly treated. I guess that if it's OK to sell home made booze to give away, sell or advertise it's OK to do the same with various other recreational drugs as well.
In case you've forgotten the rules and motives of this forum which you read prior to your joining, may I suggest that you have a refresher read. You know where they are it deals with both of these problems. One is to endeavour to make our hobby legal, the other is not to encourage sales of an illegal product. Both of which I feel are quite reasonable. Neither of this 'lads' actions help our cause,
Now if a nineteen year 'lad' does and gets two days in the slammer and if a bloke like Popcorn Sutton finishes up dead I personally think that that 'friggin' situation 'frigging' sucks. And don't give me the shits about PopCorn necking himself, because one day you may just find yourself with a similar dilemma. Prison or death!!! Just 'frigging' think about it'
When you were nineteen you may have done silly things. When I, and many others in here were a few years older that that we had families, and never had the time to be an openly smart 'chap' intent on making a lot of easy money. We were more concerned about getting a 'frigging' real job and raising our family rather than hanging around mummy and her apron strings. Many of my friends were killed, wounded or mentally deranged fighting a 'frigging' American war in Vietnam and they were only one 'frigging' year older (at best) than this moronic 'lad' being discussed here.
I know things are different now with the various gen x to z and alpha to christ knows what will be next, getting more and more greedy every 'frigging' second of the day, but that concept only applies to those in those generational brackets. Being an old war baby I believe that this 'turkey' was unfairly treated in the court. The 'lad' should have to serve his full term and maybe come out a grown man aware of his social responsible responsibities in this life, difficult as they may be.
This forum is no place to discuss the defence of a fool who knew what he was doing but thought that he was better that us poor silly old bastards in the forum.

Re: Man, 19, guilty of making booze
I don't feel like morality has much to do with this particular instance Morals can be confused with ideals or the truth (or not the truth) too easily.
Gangster in one area of the world can be a pillar of society in another part. 30 year mortage is the biggest legal rip off to the common working class slob. Wall street deals that drive grain prices through the roof.....using the lords name in vain.
Got my version of morality.
This young man at present,, has proved that he did not insulate his self as good as the other more,,,,,,moral people.
The likker part is an aside....

Re: Man, 19, guilty of making booze
I am with Goose eye here. If you even once traded shine for some copper pipe, grain, feedstore molasses, fermenter buckets, etc., you are as guilty as the accused here. The fact that you traded it for goods and not money is irrelevant. Also, be careful about calling someone stupid for bragging about their illegal activities on the internet for all to see ....the bad karma gods love a hypocrite.
Everyone here has some good, valid points, and I am not advocating the selling of your product. I just hope that most of us realize that we are committing a very similar crime in the public's eye. So you can call him a stupid arrogant criminal if you want, just realize that if you get caught, most people would look at your story and see pretty much the same thing. "He not only made it, but he openly boasted about it online and even linked youtube videos and pictures of his operation, what a stupid arrogant criminal."
Like it or not, except for the kiwi's out there, we are all criminals. I have accepted that fact, maybe the rest of you need to come to grips with that concept as well. In my mind there is nothing wrong with distilling, but it is still against the law. I am not gonna call the kid stupid for doing basically the same thing that I do on a weekly basis. The only real difference between him and the rest of us is he got caught, but, you can spin it however you like if it makes you feel better. You can draw imaginary lines if you want to; like trading is ok but selling is not, or making 1 gallon a month is ok but 5 gallons a week is not, posting on a popular distilling forum is ok, but posting on facebook is not. But, those imaginary lines don't mean much to the courts or the public's eye.
Keep it secret, only have friends that you can trust, and be careful who you call stupid.

Another eternal pessimist. All of my life I have heard, "things were so much better back then", or "society is heading down hill", or "kids just aren't right or are too lazy, in my day we did it right" or "when you grow up the world will have gone to shit." Yet health, public safety, standard of living, civil rights, education, and life span all keep improving. The doom and gloom predictions are not coming true. Everyone thinks the future will be worse yet it keeps improving. Maybe the younger generations are doing it better. Re: Man, 19, guilty of making booze
My point here is that we are endeavouring to make home distillation legal not issues of selling illegal spirits either moral or immoral. Making spirits is one thing, selling is an entirely different issue. You can be sure that this forum is checked by the law enforcement folk every now and again, and when they see this sort of shit they are going to wonder just how genuine we are in our endeavours to make home distilling legal, or at least not a criminal offence.
The bloke who got two days prison for his efforts is a total jerk and deserved his conviction. I for one have no sympathy for him - for crissake, two days jail - nor do I think that anyone who is genuinely interested in achieviong our objectives should be voicing their concern over this loser in this forum.
Think and say what you wish in a bar, at home, at your sports club, whereever, but in my opinion this is not the place. I'll leave it to our members discretion but this thread is becoming very close the action that RD has pointed out.

9. It is the hope of this forum to promote the legislation of home distilling as a legal hobby here in the United States. One of our goals, is to prove a quality product can be done safely by the home distiller for personal use only. So any discussion of selling bartering or trading any distilled liquor unless by a licensed distillery will not tolerated. Such post will be edited, deleted or locked.
If you don't like it hard luck.
